Terms of Service

1. Who we are

Koliva Studio ("we", "us") is operated by a Romanian SRL. By creating an account or paying for a subscription you agree to these terms. If you don't agree, don't use the service.

2. What you can use the service for

You may generate video, audio, and image content for personal or commercial use, subject to your subscription tier and to applicable provider terms (see §6). You retain ownership of the output you generate from your own inputs.

3. What you may not do

• Generate sexual content involving minors or non-consenting individuals.
• Generate likenesses of real people you do not have permission to depict.
• Generate content that promotes violence, incites hatred, or violates applicable law.
• Attempt to extract, reverse-engineer, or resell access to underlying provider APIs.
• Use the service to spam, phish, or impersonate.

Violations may result in immediate suspension, refund forfeiture, and referral to authorities where applicable.

4. Personal-character feature

You may only upload photographs and voice samples of yourself. By uploading, you confirm you are the depicted individual and grant Koliva a limited license to process those inputs to extract attributes and train your personal voice clone. You can revoke this license and delete the extracted character at any time from your account settings.

5. Subscriptions and credits

Subscriptions renew automatically until canceled. Cancellation takes effect at the end of the current billing period; you keep access until that date. Monthly credits roll over per your tier's rollover window (typically 3–12 months). Top-up credits do not expire. See the Refund Policy for failure-handling specifics.

6. Third-party providers

Generations route through underlying AI providers (currently including fal.ai, Anthropic, Google, ElevenLabs). Their terms apply to outputs generated via their models. Where a provider restricts access by geography or business status (e.g. ByteDance Seedance), we gate routing behind an attestation flow that you opt into explicitly.

7. Availability and warranty

The service is provided "as is" without warranty. We aim for high availability but make no specific uptime guarantee at this tier. We are not liable for indirect, incidental, or consequential damages arising from use of the service, except where such limitation is not permitted by applicable law (e.g. EU consumer protections).

8. Termination

You may close your account from the settings page at any time. We may suspend or terminate accounts that breach these terms, with reasonable notice except where immediate action is required (abuse, fraud, legal compulsion).

9. Governing law

These terms are governed by Romanian law. EU consumers retain the protections of their local consumer law where stronger.
